if one parent has full custody and remarries, can the new spouse adopt the child?

my friend married a guy who has full custody of his child. he wants her to adopt the child, but is it legal? doesn’t the mother have to give up her rights in order for that to happen?

Yes, mom has to give up her rights.
The mom has to give up her rights before the other woman can adopt the child.
I have full custody of my daughter. My husband and I are trying to have my daughter adopted but with my ex on the run we are having a difficult time doing so. I know with my situation my ex has to give concent and write that he doesnt want responsibilty any more of his child. I would have your friend talk to a lawyer about this. Talk to a lawyer that is in the state/county where the custody took place. I hope things work out for your friend. I know I have been going through with this for yrs and its no fun.
