Requirements for a stepparent to adopt a child?

My husband and I married in 2004. My oldest daughter’s biological father has had nothing to do with her for years. Her biological father is currently in prison and will be for 4 more years. We live in Missouri. He lives in North Carolina. She was born in North Carolina. I want to know what do we need to do in order for my husband to adopt her.

You need to consult family lawyers in both states (you don’t need to travel to NC – just contact a family lawyer in the NC Bar – there may be a local one – or do most of your work via phone/fax/fedex).
You should formally request bio-dad relinquish his paternal rights, first. If he refuses, you can sue to have them removed. His being incarcerated (depending on the crime) may be enough to show he shouldn’t be around. After that’s done, step-dad can adopt.

Her biological father would have to sign away his parental rights. That is a legal procedure.
